TERMS OF USE

1. General and subject of use, changes

1.1. These Terms of Use apply to the use of the online platform Plan4You (hereinafter also referred to as "the Platform"), which is provided by Austria Wirtschaftsservice GmbH (hereinafter also referred to as "aws") and the Austrian Federal Economic Chamber (hereinafter also referred to as "WKO").
1.2. The platform is intended to assist companies, in particular start-ups and small and medium-sized enterprises (all together hereinafter also referred to as "entrepreneurs"), in the preparation of business plans and financial plannings.
1.3. aws and WKO reserve the right to change these terms of use at any time.

2. The platform / registration

2.1. The platform is made available to users free of charge, even without any other consideration or economic benefit for aws and WKO.
2.2. The prerequisite for using the platform is registration as a user. In a first step, the user enters an e-mail address and a password in the mandatory fields provided for this purpose.
2.3. In a second step, the user accepts these terms of use (including the privacy policy) and sends the entry by clicking the send button provided for this purpose for e-mail verification. After sending the registration, the user receives a so-called "double opt-in" e-mail with a confirmation link. By clicking on the confirmation link, the user's account is activated, the user is redirected to the log-in page and receives a positive feedback that the account has been successfully activated and that a log-in can be performed with his e-mail address as user name and his self-selected password.
2.4. aws and WKO act exclusively as operators of the platform. No documents of any kind whatsoever (such as confidentiality agreements, sample contracts) are made available to users by aws and WKO. Neither aws nor WKO provide advice to the user, nor do they recommend or materially review the content posted.

3. Protection of content, responsibility for third-party content

3.1. All rights to the platform are held exclusively by aws and WKO. The content available on the platform is protected by copyright or other intellectual property rights and is the property of aws or WKO. The user may only use them in accordance with these terms of use and within the framework specified on the platform.

4. Scope of permitted use

4.1. The User's authorization to use the Platform is limited to accessing the Platform and to using the services available on the Platform in each case within the scope of the provisions of these Terms of Use.
4.2. The user is responsible for creating the technical conditions necessary in the user's area of responsibility for using the services in accordance with the contract. aws/WKO does not owe any advice in this regard.

5. Sharing (releasing) a plan

5.1 With the function "Share planning" an authorized user registered in Plan4You ("the authorized person") is granted reading or full access to a planning for a certain time (adjustable 1, 3 or 6 months). With full access, the Authorized User can e.g. read, modify, delete data, print the planning or export it as HTML. When using the function "Share planning", if the user name of the authorized person is entered (= e-mail address already registered for Plan4You or an e-mail address not yet registered), an information will be sent to the mentioned e-mail address that a shared planning is accessible. In order to access this planning, it is necessary to log in to Plan4You with one's own username/password. The release of the planning to an authorized person can be cancelled at any time.
5.2 It is the sole responsibility of the user to whom he/she grants an authorization, i.e. grants access to the planning in accordance with section 5.1, and it is the sole responsibility of the individual authorized person to take only those actions (e.g. make changes to the planning, print it and/or make it accessible to other persons) for which he/she has been authorized by the user. There is no check of the content of the granting of access authorization.

6. Posting of own content by the user

The user is fully responsible for the content he/she posts. aws/WKO does not assume any responsibility for checking the content for completeness, correctness, legality, up-to-dateness, quality and suitability for a specific purpose.

7. Processing of personal data, data protection

7.1. One of the quality standards of aws/WKO is to handle the personal data of users (hereinafter referred to as "personal data") responsibly. The personal data resulting from the use of the available services will therefore only be collected, stored and processed by aws/WKO insofar as this is necessary for the contractual provision of services and is permitted by legal regulations or ordered by the legislator. aws/WKO will treat the user's personal data confidentially and in accordance with the provisions of the applicable data protection law and will not pass it on to third parties without the separate consent of the user.
7.2. As part of the use of the platform, aws/WKO may conduct online surveys to analyze user behavior. Participation in these surveys is not obligatory for the user.
7.3. In addition, aws/WKO will only use personal data of the user if the user has expressly consented to this. Any consent given can be revoked at any time.

8. Disclaimer

No liability can be assumed for damages or consequential damages incurred by users through the use of services provided on the platform.

9. Final provisions

9.1. Should any provision of these Terms of Use be or become invalid, this shall not affect the legal validity of the remaining provisions. In place of the invalid provision, a valid provision shall be deemed to have been agreed which comes as close as possible to the economic purpose intended by the parties.
9.2. These Terms of Use are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
9.3. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms of Use shall be the registered office of aws, insofar as such an agreement on the place of jurisdiction is permissible.
